**Job Description:**
The Inhouse Healthcare Counsel will help lead the legal and compliance
function for our growing business. They will provide senior management with
effective advice on company strategies and their implementation, manage the
legal function, and obtain and oversee the work of outside counsel. Applicant
must have a demonstrated 3+ years of ability, and firm understanding, of
healthcare contracting and compliance with a focus on the federal, state and
local laws. The areas of knowledge include, inter alia, Anti-kickback Statute,
Stark Law,
Health Insurance Portability and Accountability Act (HIPAA), Affordable Care
Act, and
Food, Drug, and Cosmetic Act. Applicant will have a demonstrated experience
and
talent for the tasks laid out for this role. The role is 100% remote, offering
the
applicant outstanding work flexibility.
**Key Responsibilities:**
• Negotiate, write, and review contractual agreements in the healthcare and
insurance space, including, inter alia, healthcare, insurance, lab service,
general service and lease agreements.
• Serve as healthcare law subject-matter expert in contractual matters and
compliance issues.
• Counsel company’s leadership and working personnel on compliance with
healthcare regulatory requirements and assist in developing strategic
solutions.
• Prepare, update and maintain healthcare related policies and procedures.
• Provide organizational compliance training on substantive legal matters and
procedural policies.
• Conduct internal compliance reviews and investigations in cooperation with
company leadership.
• Advise company’s executives leaders on the terms and terminology of
contractual matters and business arrangements.
• Perform dispute-related and pre-litigation review in coordination with team
leaders.
• Engage and work with in-house leadership and outside counsel on disputes and
active litigation matters, including discovery items, hearings, and trial
level matters.
• Research relevant legal issues to locate applicable federal and state
statutes, regulations, administrative proceedings, and relevant case law.
• Coordinate with leadership to draft and maintain risk management and
compliance initiatives for healthcare operations.
• Work with company leadership to minimize healthcare law related risk and
ensure company policies are implemented consistently.
• Work with outside counsel, as required, to manage litigation and other
matters.
• Provide training to healthcare team and its affiliates on substantive legal
topics.
• Oversee tracking and reporting of potential breaches to state and federal
agencies.
• Provide advice on legal issues impacting the healthcare arena.
**Qualifications:**
• Juris Doctor and bachelor’s degrees.
• Membership in the Bar of a U.S. state.
• 5+ years of significant and substantive experience at a highly regarded law
firm or U.S. public or private corporation.
• Demonstrated experience in healthcare and healthcare insurance law.
• Demonstrated experience in contractual and compliance matters in the tasks
listed for this position.
• Ability to work and achieve results in the fast-paced environment of a large
company moving at startup speed.
• Director level experience working in a corporate setting is required.
• Can manage a small team of employees while still being hands on in all legal
services, task, and deadlines within the company.
• Excellent oral and written communication skills.
• Ability to readily understand numerous technologies and software packages.
• Ability to handle multiple, deadline driven projects/tasks simultaneously.
